Background
The proposed extensions were refused by the planning committee despite the officer’s recommendation for approval, and the subsequent appeal was dismissed. Hence, we were brought in to explore development options.
Our Approach
We carefully reviewed the appeal decision and advised targeted amendments to address the inspector’s concerns. Before submission, we engaged with the Local Planning Authority (LPA) to clarify the impact on daylight, sunlight, and outlook.
To strengthen the case, we submitted a Certificate of Lawfulness to demonstrate a fallback position and provided a robust argument that the revised proposal would not result in detrimental amenity impact, considering orientation and the objector’s property depth.
Outcome
Despite strong objections from neighbors and an attempt by the planning committee chair to call in the application, the proposal was granted under delegated authority. Approval was secured for a single and two-storey side-to-rear extension, along with a single-storey rear extension. This decision provides the client with much-needed additional space for their growing family.
